When Jack arrives back at Newman, he shares an elevator with Phyllis and Nick. Although Phyllis imagines ‘hitting on Jack’ – and making Nick jealous enough to claim her as his wife – Phyllis is snapped back to reality when the doors open and Nick rushes out without waiting for her!
Later, still at Newman, after Phyllis confronts Nick about Michael guilting him into going to the trial, she falls apart and expresses what a great relationship they used to have. Through tears, Phyllis asks, “You don’t remember ever loving me, do you?” However, Nick replies, “I told you I’d be there for you and I will be.” As hard as it is, Phyllis declines Nick’s obligation and says, “Do me a favor and stay away from the trial.”
In the Newman conference room, with Nick present, Michael warns Phyllis to be on her best behavior in court during jury selection. As Phyllis weeps, Nick assures her he’ll take care of Summer, and Michael promises to do his part as her attorney.
At The Club, although Phyllis tells Michael she doesn’t want Daniel at the trial – and doesn’t know if Nick will be there – Michael warns that both Nick and Daniel need to be there, by her side, then says, “If your family doesn’t show love for you, no one will.” Once Michael leaves, Phyllis calls Nick and asks him to meet her at The Club. However, Nick informs Phyllis that he can’t then says, “Sharon’s going out of town to finish up that photo shoot and I’m going with her.” Although Phyllis acts as though she’s okay with it, she tells Nick to have fun then quickly hangs up.
Just then, Brad and Sharon approach Phyllis. After the three exchange taunting remarks, Brad hands Phyllis some money then says, “Have a drink on me.” As Sharon and Brad leave Phyllis’s table, Michael rejoins returns. Although Michael tells Phyllis to leave Sharon and Brad to him – and for her to work on Nick – Phyllis replies, “Nick is who I’m worried about... He’s going out of town with Sharon.” Once alone, Phyllis sees Cane at the bar, joins him and the two share introductions while they drink…
When Phyllis brings Nick home to the tack house, she briefly reintroduces him to Summer’s babysitter then quickly checks on Summer. Although Nick feels uncomfortable, Phyllis shows him where he used to work and keep his things. Just then, Summer begins crying and Phyllis rushes back upstairs yelling over her shoulder, “Why don’t you make some coffee.” Once she’s gone, Nick looks around and replies to himself, “Sure, where’s the coffee?” When Phyllis comes back downstairs, she continues giving Nick a tour of the house then says, “I’m sorry our home feels so strange to you,” and Nick replies, “I’m sharing a home with a beautiful woman. It can’t be a terrible burden.” Later, when Phyllis suggests they go to bed, Nick says, “Do you mind if I sleep on the couch?” Although disappointed, Phyllis replies, “I understand,” then heads up to bed – alone.
Later that night, Phyllis goes downstairs, waits till Nick wakes up, removes her robe and says, “Do you mind if I join you?” After Nick says, “Okay,” Phyllis lies on top of him and they share a passionate kiss! Although Nick expresses how beautiful she is – and that he can see why he married her – Nick ultimately pushes Phyllis away… However, Phyllis rests her head on his chest, refusing to leave, wanting to spend the night on the couch with Nick…
In the Newman elevator, although Phyllis offers to help Jack with a Clear Springs meeting, she suddenly remembers that Nick is moving back to the tack house tonight.
In Victor’s office, although Nick can’t believe his parents are splitting up, Sharon tells him that Nikki and Victor will work things out. Just as they begin talking about a benefit for Cassie, Phyllis arrives and offers her help. However, Sharon says it’s not a good idea and worries that the controversy surrounding Phyllis’s trial will ruin it. After Sharon leaves, although Phyllis begs Nick to allow her to help with Cassie’s benefit, Nick says, “You should be concentrating on the trial. Sharon and I can handle this.”
When Phyllis goes to Jack’s office to talk about the plans for Cassie’s benefit, she warns Jack that Nick is trying to do everything to get Sharon back. Although Jack trusts Sharon, Phyllis says, “We have to stop this before it goes any further. If I go to jail, my husband is fair game for your wife.”
