The DA tells Josh that Dixie and Zach are "as good as convicted."
At the courthouse, JR, accompanied by Babe, asks Josh not to reveal Colby's action, saying she's 16 and made a mistake. Josh says the secret's safe with him.
Zach tells Ryan to take his "good luck speech and stuff it", saying Ryan's only interest is moving in on Kendall. He admits he does want Kendall—but not by default.
Erica and Jeff sit down next to Josh in the courtroom, saying they want to show their support for him. Dr Joe enters at that moment, and sits down in the back of the courtroom.
In the prosecutor's opening remarks, he claims to have ironclad evidence that Zach and Dixie committed murder.
Livia says that while Zach and Dixie had a motive, but didn't commit the murder, the prosecution evidence is circumstantial, and Tad is motivated by revenge and hate.
She cross-examines Derek; hereacts angrily when Livia accuses the police of questionable activities,
Josh has images of Julia attacking and injecting Madden; Di and Del planning to bury him; David digging the grave [but promising to release him if he tells the truth about Kate's whereabouts]; JR helping David; Dixie is observing.
Tad is called to the stand, and admits that the police bugged his house. He admits that Dixie eventually admitted to him that she and Zach were lovers. He says he saw Dixie and Zach in the airport parking lot the night Madden disappeared, and were putting a body in Dixie's car.
Livia asks Tad if it's true that he's there because Chief Frye told him if he didn't testify, he'd go after JR and Jamie for stealing evidence. Tad admits it's true.
He also admits that David helped Dixie get away from him when she was pregnant, and he believed her to be dead. Livia questions his feelings about Dixie not asking for his help in finding their daughter.
The prosecutor asks Tad about his "anger" regarding Dixie's actions, and whether that's affected his testimony. Is it the truth? Tad says it's all the truth—and Jamie and Di burst in, Jamie yelling "Liar! Everything he's said is a lie, and I can prove it."
Colby "wakes up" and feigns amnesia, claiming she can only remember water and music. Neither Josh nor Babe believe her, and ask Sydney for the 411. She breaks and spills the beans; Colby angrily tells her to shut up, and claims Sydney promised to help her.
Colby tries to incriminate Sydney, and Babe tells Sydney "shame on her" for knowing Colby was alive and not letting them know. Colby asks them to help her escape, but Babe tells her she can't do that.
"You're going to play it my way," says Colby. "If I don't have amnesia, I just might remember what I know!"
At the Chandler manse, Dixie tells JR she doesn't want him in the courtroom, hearing all the things they're going to say about her. Adam enters, and Sydney rushes in, announcing "she's back."
Adam hurries to the other room and is reunited with Colby. She continues with her amnesia ruse. JR coldly asks why Josh is there. Colby acts as if she doesn't know Adam or JR; Babe tells everyone that Colby's lying.
Adam reacts angrily, Colby crumbles and admits "everything spun out of control." She tells Adam she was going to hide until she could get away—figuring Adam didn't want to love her anymore. She denies knowing she drank alcohol, believing it to be lemonade, and Adam forgives her.
After Adam and Krystal leave the room, JR compliments her on a "great performance." Colby spitefully tells JR she heard "everything" about Josh and Babe while in the tunnel. JR asks how she can trash Babe after all she's been putting the family through.
Colby says Josh and Babe slept together but JR doesn't believe her. He says he and Babe love each other, and if Colby says one more thing about Babe, she'll regret it.
He tells her she can't con him or Babe. "You both suck!" cries Colby and runs out of the room. Josh tells Babe he loves her and would trust her with his life.
Back at Fusion, Josh and Kendall discuss his relationship with Babe.
Josh asks if he's going to the trial. Kendall says she's going to be smart from now on, and not focus on feelings, since Zach has made it very clear how he feels about her. She can understand why Josh is going, but she doesn't need the hurt.
Josh tells her she's still Zach's wife and should be there, but she claims he doesn't care about her.
Krystal asks Babe if she broke her marriage vows, and Babe nods and admits she did. Does she still want her marriage? Babe admits she doesn't know, but wants a man who looks at her the same way Adam looks at Krystal.
Babe says he has problems knowing just what she's feeling about JR, and that Josh gives her something JR never has. Is it possible to be in love with two men at once?
Krystal says Babe has to decide what she honestly wants. If it's JR, she should never let JR know what happened.
The doorbell rings and Brooke is there to offer condolences to Adam, and embraces him. She tells him she knows that losing a child is the worst thing that can happen to a person.
After she's done speaking with Adam, Brooke sits down next to Tad and tells him he can't strike back at Dixie just out of anger, and that what he says in court today will affect JR and Jamie for a long time.
A distraught Sydney tells Winifred she has to leave! Adam overhears and asks her to sit with them, and assures her she's part of the family and that he wants her to stay.
Colby is still in the tunnel and overhears all the conversations.
When Babe goes to answer the doorbell, Josh is standing there. She's shocked to see him and asks what he's doing there. He says he wants to talk—and they overhear the voices in the tunnel.
He opens the door and reveals Colby and Sydney. "You look pretty good for a dead person!"
After looking through the empty Fusion office, JR opens the door to the roof and sees Babe, standing naked. She claims the pool is from a photo shoot, and she went to swim out there since the A/C went off in the office. She tells JR that Josh went home hours ago. JR tells her he wants to make love—she declines. He apologizes for coming on strong and tells her he loves her. She turns away and leaves. Josh, hiding behind some shrubs, witnesses the entire thing.
Josh comes to Kendall's door in the middle of the night and they talk. He's angry and says "someone has to blow up that marriage." She talks about how much he hates JR and wonders why Babe goes back to him.
He tells Kendall that Zach is going to go to prison and Kendall should jump off this "sinking ship."
Kendall admits she tried to convince Babe to leave JR and go with Josh. She says she knows by the look in his eye--"pure Kane"-- he's going to blow up Babe and JR's marriage.
Josh and Babe continue to kiss. He tells her his wants her, and wants to know if she feels the same. She pulls him closer and tells him she does, and that she wants him to make love to her.
He spreads his jacket on the office floor, they undress and make love.
Babe and Josh are confiding each other and kissing, post making love. She talks about how she'd like to make love by a waterfall. He leaves for a moment, then returns and carries Babe out of the office, onto the roof and plops her into a filled wading pool—the closest thing that night to her waterfall fantasy.
JR goes up to the office and calls for Babe. He sees their clothes on the floor, picks up Babe's top and wonders "where the hell" she is.
